NOC for Cars: Step-by-Step Guidelines

As a car owner, you’ll be requiring a No Objection Certificate for your car for different reasons. You need an NOC when you have cleared the loan you had taken while purchasing the car. It helps you remove the hypothecation status from the Registration Certificate (RC) of your car. Also, when you transfer your RC from one Regional Transport Office (RTO) to another, you need an NOC from the previous RTO. Similarly, there are some other scenarios where you will need to NOC for your car. In this article, we have discussed all these scenarios and explained how to obtain the NOC for your car in a detailed manner. 

Situations for Which an NOC is Needed

As a car owner, you’ll need an NOC for different circumstances that are explained below: 

1. Relocating to a New State 

If you are relocating to a new state and will be driving your car in that state for more than 12 months, you’ll have to obtain the NOC from your existing RTO first. 

2. RC Transfer 

If you sell your car to a buyer who resides under a different RTO jurisdiction, you’ll need to obtain an NOC from the current RTO and provide it to the buyer. This document helps ensure that the vehicle’s RC transfer can be completed smoothly at the new RTO.

3. Car Registration 

If you want to change your car’s registration from one RTO to another for any specific reason, you must get the NOC from the existing RTO in which your vehicle is registered. 

4. Removing Hypothecation 

The consent form must be acquired from the bank after clearing the vehicle loan you had taken while purchasing the car. You can then use this consent to remove the hypothecation from your car’s RC. 

How to Obtain the NOC for RC Transfer?

You can get the NOC for RC transfer through both online and offline methods. We will discuss each of these methods in detail now: 

1. Online Method 

It is possible to obtain the NOC for RC transfer through an online process. The following steps will guide you for the same: 

• Step 1: Visit the official website of Parivahan Sewa as we will be using this portal to apply for the NOC online. 
• Step 2: After opening this site look for the ‘Online Services’ tab. Choose it and then select the ‘Vehicle Related Services’ that will appear as one of the options.
• Step 3: Now, you’ll have to choose your state and enter your vehicle registration number in the designated field. To proceed further, you will have to choose the option of No Objection Certificate application link. 
• Step 4: This application form is also known as Form 28 as it is the official form to be used for obtaining the NOC in India. Fill the Form 28 form duly with all the details regarding your vehicle and state and RTO which you want to transfer your RC to. 
• Step 5: After filling the form correctly, you will have to submit some documents as well. The list of those documents will be mentioned below for your reference. 
• Step 6: Upon completing these steps, you will have to clear the associated fees online. Now, print a copy of the application form and payment receipt and submit these copies to the RTO during the in-person verification process.

Documents Needed to be Submitted with Form 28

These are the documents you must submit along with Form 28 while obtaining the NOC for your car: 

• Registration Certificate or RC of your vehicle
• Vehicle insurance certificate 
• Acceptance of loan clearance from bank/financier (for cars taken on loan or lease)
• Pollution Under Control (PUC) Certificate 
• Your Proof of Identity (POI) and Proof of Address (POA)
• Engine number and chassis number pencil prints
• Road tax payment receipts obtained at the time of purchasing the vehicle 
• For transport vehicles, additional documents such as fitness certificate, tax clearance, challan clearance, and permit surrender evidence should be presented along with these documents. 

It is worth noticing that the online process for obtaining the NOC might not be available in all the states. So, you must also know how to obtain the NOC through offline means. The method to obtain the NOC through an offline method has been discussed below. 

2. Offline Method 

For the offline method, you must visit the concerned RTO in-person along with the documents that we have discussed in the above section. After that, you can follow these steps to complete the application for NOC:

• Get the Form 28 from the RTO and fill it correctly. You will have to fill and submit 3 copies of this form and submit it with the aforementioned documents.
• Also, the applicable fees need to be paid while submitting the documents. This fee is generally around Rs. 100. Do not forget to collect the payment receipt after submitting the fees. 
• The documents and form will be checked by the RTO directly and you’ll be asked to submit any pending documents. 
• If there are any legal issues such as pending challan, you’ll be asked to clear that before providing the NOC. If everything is ok, the RTO will issue the NOC with a fixed validity which is usually 6 months from the date of issuance.

What Happens if You Don’t Obtain the NOC?

You should also be aware of the consequences that you’ll have to face if you don’t get the NOC from the RTO. Here are some of the issues you’ll have to face if you fail to get the NOC at the right time: 

If you drive a vehicle in another state for more than 12 months without an NOC, you will have to pay some fine imposed by the traffic inspector of that particular state. If you are found doing so on multiple occasions, you might have to face some legal actions as well. 

1. Ownership Transfer Issues 

If you are selling your vehicle to another person without an NOC, your RC transfer process may be halted. Without transferring the ownership to the buyer, you won’t be able to complete the selling procedure. 

2. Registration Problems 

In case you apply for vehicle registration at another RTO, your application will be rejected if you don’t submit the NOC. So, re-registering your vehicle will be an issue if you don’t obtain the NOC on time. 

3. Steps to Check NOC Status Online 

After applying for the NOC, you can also check the NOC status online. For that, you will have to follow these steps: 

• Go to the Parivahan Sewa portal first and find the ‘Online Services’ tab. 
• Now, search for the ‘Know Your Application Status’ link. Click on it to proceed further. 
• Enter your application number in the designated field. For that, you must save the application number that you will get after submitting the Form 28 and fees. 
• Once you enter the application number, you can click on the ‘Check Status’ button. After clicking this button, the application status will be displayed on the screen.
